           I recently separated from my former spouse and need a Divorce. Where do I start?
          &#xD;
    &lt;/span&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The media often makes reference to ‘getting a Divorce’ after a separation. Wonderley &amp;amp; Hall Family Law Toowoomba provide clarity to what this means.

    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           What is involved in getting a divorce?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If you have separated from your husband or wife, a divorce is only one of legal processes that will need to happen and we often advise clients that the divorce is the last of those processes. To apply for a divorce, you need to have been separated from your former spouse for at least 12 months. Once this time has been served, you can file an Application for Divorce with the Court, and formally serve on your spouse, or on his or her lawyer. In some cases, formal service is not necessary (e.g. where you have both agreed on and signed a joint Application for Divorce). 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            A court date is set, and there is a hearing that no one needs to attend, at which time the divorce is granted. The outcome is recorded on the Commonwealth Courts Portal. In one month and one day, your Divorce Order will come into effect. You will receive a copy of the sealed Divorce Order to show this. From that day on, you are free to re-marry. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           So, in a nutshell, a divorce is an isolated legal process which results in you and your spouse no longer being recognised as ‘husband and wife’.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Does getting a divorce mean the house is sorted?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           No. Just because you are divorced, does not mean there is a final agreement or court Order on how the house, cars, bank accounts, superannuation etc, are divided. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Sorting out who gets the house (or whether it is sold and how the proceeds are divided), is what is called a ‘Property Settlement’. To finalise a Property Settlement, there are a few practical steps involved, which take a bit longer than obtaining a Divorce Order. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           These steps to a Property Settlement include:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ol&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            Providing Disclosure
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        
            – This means giving each other full disclosure of what each of you currently own and owe (Assets and Liabilities) including your superannuation balance/s.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            Obtaining Valuations
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        
            – This is only needed if you do not agree on the estimated value of significant items in the pool, such as the house, investment properties, business / company shares, and/or superannuation.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            Doing up a Balance Sheet
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        
            – Now that all disclosure is completed, and valuations are in, both you and your former spouse are in the position to agree to a Balance Sheet.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            Reaching an Agreement
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        
            – This is where you and your spouse have agreed on a percentage or monetary split of the pool, and it is formalised in a Binding Financial Agreement or by completing an Application for Consent Order to file with the Court. In some cases, if an Agreement cannot be reached, it may be advised that the matter go to Mediation. As a last resort, there may need to be litigation.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;strong&gt;&#xD;
        
            Settlement Day
           &#xD;
      &lt;/strong&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;span&gt;&#xD;
          
             – This is day the transactions agreed upon are effected. For instance if it is agreed that you keep the house and the mortgage is discharged and refinanced in your sole name, a Settlement Date will be set for the transfer, discharge and refinance. 
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ol&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Does this mean I should finish the Property Settlement before the divorce?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Yes. Although you may wish for a divorce as soon as possible, our family lawyers will give you tailored advice as to whether it is best to get your Property Settlement sorted first, or at least at the same time as the divorce. The main reasons is that once a Divorce Order comes into effect, you and your spouse will only have 12 months to resolve your property matters before the time limit for filing proceedings for a court ordered property settlement expires. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In most cases, a person is usually better off obtaining the divorce after the property settlement is finalised. That way you will not be in a position where you are trying to reach a property settlement agreement while the clock is ticking.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;

These events all have legal consequences, and if your Will hasn’t kept up, it may cause more problems than it solves.

           There Is No Set Age

           In Australia, there is no specific age at which a child can legally decide where they want to live. Instead, the Family Court takes a broader view, assessing what is in the child’s best interests as the primary consideration. While the views of a child can be relevant, those views are just one of many factors the Court considers when making parenting orders. A child’s preferences may be considered, but they are not determinative.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           When the Court is asked to determine living arrangements for a child, it considers a wide range of factors, including:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The child’s age and maturity
           &#xD;

            Whether their views are independently formed or influenced by others

            The nature of the child’s relationship with each parent

            The capacity of each parent to meet the child’s needs
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The need for stability and routine in the child’s life
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Any risks or concerns, including exposure to family violence, neglect, or abuse.
           &#xD;

           Depending on the complexity of the matter, the Court may appoint a Family Consultant to prepare a Family Report, or an Independent Children’s Lawyer (ICL) to represent the best interests of the child. These tools help the Court assess the child’s needs and preferences in a safe, neutral, and professionally guided way.

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

      <title>Interim Hearings &amp; Interim Orders in Children's Matters</title>

           Why does the Court make interim orders?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
&lt;/div&gt;&#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           There are two types of Court order that can be made by the Federal Circuit and Family Court of Australia in parenting or children’s matters - interim orders and final orders.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Final orders are what most people think of when they think of a ‘Court order’. These are binding, long-lasting orders that are made by a Judge or other judicial official, either by consent or after a lengthy final hearing.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interim orders have the same force and effect as any other kind of Court order, but they are made in different circumstances.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It can often take over 18 months from the date of filing documents in the Federal Circuit and Family Court of Australia for a parenting matter to reach a final hearing. It will often be undesirable for parenting arrangements to remain in dispute for that considerable length of time whilst parents are moving their cases through the Courts. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           For that reason, in almost every parenting matter, interim orders are made as a ‘stop-gap’ measure, before the matter can be fully heard at a final hearing.
           &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           What happens in an interim hearing?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interim orders are made either by consent between the parties to the proceeding, or after an interim hearing.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            ﻿
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interim hearings are special, short-form Court hearings that are often conducted by Senior Judicial Registrars, who are lower-level judicial officials in the Federal Circuit and Family Court of Australia who have many of the same powers as Judges.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interim hearings usually take no more than 1 to 2 hours. There are various special rules that apply to them.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Firstly, except in extenuating circumstances, there is no cross-examination. That means a party to a case, if they are represented by a lawyer, will usually not need to say anything at all – they can let their solicitor and/or barrister do the talking.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Secondly, because a person who is a party to a case at an interim hearing does not need to say anything, they will need to rely on an Affidavit, which is a Court document that tells the Court what facts support the orders they are seeking. To save time, at interim hearings, Affidavits are usually limited to 10 pages and 5 annexures. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Finally, a judicial official cannot make any findings of fact at an interim hearing. That means they will not be able to decide whether one person’s version of events is correct or not. Because of this, the judicial official’s approach will usually be one of caution. As they cannot determine which version of events is truthful, except in very obvious cases, they will ordinarily try to identify what everyone’s concerns are, and fashion an outcome that deals with all of them. This can sometimes be a difficult balancing act.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;

    &lt;span&gt;&#xD;
      
           What can I do if the interim orders aren't in my favour?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interim hearings in parenting matters are almost always a critical junction point, because they happen at an earlier stage in the proceedings. A parent who manages to obtain orders that they seek at an interim hearing will quite often set them up for further success down the track.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Nonetheless, for a parent who is unsuccessful at obtaining the orders they seek at an interim hearing, that is rarely the end of the story. Careful management, analysis of the reasons for the interim decision, and the obtaining of further evidence can often help an initially unsuccessful parent to turn the tide and obtain the orders they seek at a final hearing.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In family law matters (particularly property settlement matters), it is important to determine whether you and your partner are considered to be in a de facto relationship or not. If you satisfy the criteria for a de facto relationship, then there may be various implications if you separate.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           De Facto Criteria
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You and your partner may be considered to be in de facto relationship under the Family Law Act 1975 (Cth) if you have a relationship as a couple, living together on a genuine domestic basis. Some of the factors that a Court may take into account in determining whether a de facto relationship exists on a genuine domestic basis include:-
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The duration of the relationship;
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The nature and extent of your common residence (such as how many nights you spend together and whether you help each other with tasks in the common residence like mowing the lawn or cleaning the house);
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Whether an intimate relationship exists;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The degree of financial dependence/interdependence and any arrangement for financial support between you (like who pays for groceries, bills and the like);
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Whether you own any items of property together, use property together (like share a car) or whether you contributed to the purchase/deposit on a house;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The degree of your commitment to a shared life (whether you have plans for the future);
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Whether you have children together and how you share care of those children;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Whether your de facto relationship is ‘registered’; and
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The reputation and public aspects of your relationship (whether you introduce your partner to your friends, colleagues and the general public as your “partner” or not).
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Importantly, you don’t need to tick all of the above boxes to be considered to be in a de facto relationship.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Interestingly, you can be considered to be in a de facto relationship with one person, even if you’re still married to another person.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Court Requirements
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Another important factor to note is that even if you’re considered to be in a de facto relationship, you may not yet satisfy all the criteria required to make an Application the Federal Circuit Court for property settlement and/or spousal maintenance matters. In addition to being considered to be in a de facto relationship, in order to file an Application in the Court, you must:-
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Meet one of the following criteria:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            That you’ve been in a de facto relationship for at least two (2) years;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            That there is a child in the de facto relationship;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            That the relationship is or was registered under a prescribed law in a State of Territory;
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If one or both of you has made significant contributions and a failure to make an order would result in a serious injustice (for instance – if you haven’t been together for two years but one or both of you have made significant contributions that justify the Court’s intervention otherwise one or both of your would suffer a serious injustice).
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            You have a geographical connection to a participating jurisdiction (meaning you, your partner, or both of you, must have been living in a participating jurisdiction – any State or Territory of Australia aside from Western Australia – at the date you commenced the proceedings).
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Your relationship broke down after 1 March 2009 (or after 1 July 2010 if you have a geographical connection to South Australia only).
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Time Limits
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If you have separated from your de facto partner and you need assistance from the Federal Circuit Court to determine your property settlement and/or spousal maintenance matters, you must file an Application within two (2) years from the date of your separation. This is different to the time limit following a Divorce, which is that you only have one (1) year from the date your Divorce takes effect in which to seek the Court’s assistance. After the two (2) years has expired since your separation, you will need the special permission of the Court to apply, which is granted in limited circumstances only.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           On 1 September 2021, the Federal Circuit and Family Court of Australia commenced operations. It combines the previous Federal Circuit Court of Australia and the Family Court of Australia. The Court has some changes to process and procedure and a greater focus on matters being resolved quickly without the bitterness of protracted litigation.
